1. Petitioner seeks quashing of FIR No.0096 dated 05.04.2025 under Sections 115, 316(2), 351(2) and 85 Bharatiya Nyaya Sanhita, 2023, Police Station Butana, District Karnal and all consequential proceedings arising therefrom, on the basis of compromise dated 16.01.2025.

2. On 18.03.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise dated 16.01.2025.

3. In compliance of the aforesaid order, parties appeared before learned JMIC, Karnal on 24.03.2026. Statement of Investigating Officer P/SI Anil Kumar was recorded on 25.03.2026. Learned JMIC, Karnal has submitted his report recording satisfaction that all the parties have entered SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-14750-2026 (O&M) -2- into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:

"1. Number of accused arraigned in the FIR. Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal there is only one accused namely Sumit son of Roshan Lal arraigned in the FIR.
2. Number of accused who have appeared before the Trial Court and made statements.
Ans. As per the statement of parties, there is one accused namely Sumit son of Roshan Lal who have appeared before the Trial Court and made his statement.
3. Whether during investigation, any additional accused has been added and he/she is a party to the compromise. Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal, during investigation, no additional accused has been added in the present case.
4. Whether any of the accused is an absconder/proclaimed person(s)?
Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal, accused namely Sumit son of Roshan Lal is not declared as absconder/proclaimed person.
5. Whether after the registration of the FIR, any offence was added or deleted during investigation.

Karnal, present FIR has been registered under Sections 115, 316(2), 351(2) and 85 of BNS, 2023 and no other offence was added or deleted during investigation.
6. Whether investigation is pending against any of the accused or any accused has been declared as innocent. Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal, investigation is not pending against the accused namely Sumit son of Roshan Lal and no accused is declared as innocent during investigation.
7. Name(s) of the complainant and injured/aggrieved. Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal, name of the complainant/injured/aggrieved is Ritu Devi.
8. Whether all injured/aggrieved have appeared and their statements recorded.
Ans. Yes. Complainant/injured/aggrieved namely Ritu Devi have appeared and recorded her statement.
9. The stage at which the trial is pending. Ans. The present case is pending at the stage of appearance of accused Sumit.
10. Satisfaction of the Trial Court that the compromise is genuine, voluntary and out of free will of the parties. Ans. As per the statement of parties, it appears that compromise entered between the parties is genuine, voluntary and out of their free will.

11. Whether any other criminal case or proceedings is pending against the accused.
Ans. As per the statement of P/SI Anil Kumar, P.S. Butana, Karnal no other criminal case or procedings are pending against the accused namely Sumit son of Roshan Lal.
12. Whether any IO appeared or not and if appeared, his/her statement be recorded or not.
Ans. Yes. P/SI Anil Kumar, P.S. Butana, Karnal has appeared before the Court and recorded his statement being authorized person since the Investigation Officer in the present case is SI Gurbachan and now he is transferred."

4. Learned State counsel and learned counsel for respondent No.2 have not raised any dispute regarding the factum of compromise between petitioner and respondent no.2.

5. Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 528 BNSS.

6. Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.

7. FIR No.0096 dated 05.04.2025 under Sections 115, 316(2), 351(2) SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-14750-2026 (O&M) -5- and 85 Bharatiya Nyaya Sanhita, 2023, Police Station Butana, District Karnal and all consequential proceedings arising therefrom, are quashed qua the petitioner.

8. Pending miscellaneous applications, if any, stand disposed of.
