1. On 08.07.2021, the following order was passed:-
"Learned counsel for the petitioners submits that the grant of relaxation in favour of a particular category is causing prejudice to the petitioners. Learned counsel for the petitioners concedes that as of now, the petitioners are not eligible for promotion but submits that relaxation granted to the others will ultimately cause prejudice to them.
The question before this Court is whether, the action of Government, exercising powers for the relaxation of rules, which is available under the rules, the grant of relaxation in the rules governing the service can be interfered with by this Court in the absence of any mala fide or allegations of colorable exercise of powers.
Admitted.
To be heard within a period of two years."
2. On 02.12.2025, the following order was passed:-
"From the perusal of the office report, it is evident that the main writ petition is admitted and service upon the respondents is still pending for want of process fee. Despite issuing e-mail and letter to learned counsel for the petitioners, no compliance has been made yet.
Let notice be issued to the petitioners, returnable for 05.03.2026."

3. As per office report, notice issued to petitioner No.2 was served through his brother, whereas, notice issued to petitioner No.1 received back with a report that he is not found residing at the given address.
4. In view of the above, it appears that neither the petitioner(s) nor his counsel is interested in pursuing the present petition. IOIN stands disposed of accordingly.
5. Since the main case is on regular board of this Court being admitted on 08.07.2021, the main case is ordered to be taken up on board for today itself.
CWP-12171-2021
1. The present civil writ petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari for setting aside the impugned notification dated 05.10.2020 (Annexure P-16) and impugned order dated 22.03.2021 (Annexure P-15). Further, for issuance of a writ in the nature of mandamus directing the respondents to re-designate the cadre of Firemen to the post of Fire Operator w.e.f. 03.06.2016 and also to consider the case of petitioners for promotion to the post of leading Fireman under Old Rules i.e. Haryana Municipal Corporation Employees (Recruitment and Condition) Rules, 1998. Further, to consider the case of the petitioners for grant of 1st MACP w.e.f. 28.09.2018 & 13.09.2018 respectively after completion of 08 years of regular service as Firemen.
2. Today, the case has been called twice but none has put in appearance on behalf of the petitioner(s).
