In the present petition, grievance being raised by the petitioner is that the daily wage service, which the petitioner had rendered with the respondent-department prior to the regularization of her service has not being taken into account as qualifying service for computing her pensionary benefits.

Learned counsel for the petitioner submits that the said action on the part of the respondents is totally arbitrary and illegal and is contrary to the judgment of the Full Bench of this Court in Kesar Chand vs. State of Punjab and others, AIR 1988, P & H 265.

Notice of motion.

Mr. H.S. Baath, Advocate accepts notice on behalf of the respondent-University and submits that he has instructions that order dated 1 of 2 ::: Downloaded on - 28-09-2024 00:59:10 ::: Neutral Citation No:=2024:PHHC:117913 CWP-21922-2024 -2- 01.03.2024 (Annexure P/9) be treated as withdrawn and liberty be granted to the respondent-University to pass an appropriate order by keeping in mind order passed by the Full Bench of this Court in Kesar Chand (supra), which order will be passed within a period of 08 weeks from the date of receipt of copy of this order and for whatever benefits, the petitioner is found entitled for, the same will be extended to her within a further period of 04 weeks.

Learned counsel for the petitioner submits that keeping in view the statement of the learned counsel for the respondent-University, present petition may kindly be disposed of having been not pressed any further.

Ordered accordingly.
