Learned counsel for the petitioner submits that keeping in view the judgment of the Coordinate Bench of this Court in CWP-4629-2012 titled as Sunil Kumar Sharma and others vs. State of Punjab and others decided on 19.02.2018, the petitioner is entitled for the grant of benefit of service rendered by him in an aided institution, which benefit is not being extended to him by the respondents, which action of the respondents is totally arbitrary and illegal hence, the respondents be directed to grant the said benefit to the petitioner in terms of the order passed by this Court in Sunil Kumar Sharma (supra).
Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the legal notice dated 12.08.2024 (Annexure P-4) but the same is still pending consideration with the 1 of 2 ::: Downloaded on - 10-11-2024 23:38:54 ::: Neutral Citation No:=2024:PHHC:136719 CWP-28110-2024 -2- respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.
Notice of motion.
On the asking of the Court, Mr. Charanpreet Singh, AAG, Punjab, who is present in Court, accepts notice on behalf of the respondent- State and submits that in case, legal notice dated 12.08.2024 (Annexure P-4) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority by passing an appropriate speaking order within a period of eight weeks from the date of the receipt of copy of this order and in case, it is found feasible to accept the claim of the petitioner, the same will be accepted, otherwise due reasons for not accepting the claim of the petitioner will be mentioned in the speaking order so passed, which order will be conveyed to the petitioner for his information and necessary action.
Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further.
