For, learned counsel for the parties are ad idem that the matter in issue in both these petitions is identical, these are being disposed of by a common order and judgment. However, facts are being derived from CWP-3057-2002.

Learned counsel for the respondents submit that pursuant to the letter(s) of allotment dated 10.05.1999 (P-4) and 25.07.2003 (P-11), a site/plot, situated in Sector-38 West, Chandigarh, was allotted to the petitioner(s) or his successor(s)-in-interest and he has since been delivered actual physical possession thereof. Further, it is submitted, for no dues were outstanding against the subject site, prior to the date of 1 of 2 ::: Downloaded on - 28-10-2024 21:21:20 ::: Neutral Citation No:=2024:PHHC:138898-DB CWP-3057 and 2063-2002 -2- delivery of actual physical possession, no such demand in this regard would be raised even in future. Thus, it is urged that nothing substantive survives in these petitions and the same be disposed of, as having been rendered infructuous.

That being so, learned counsel for the petitioners submits that let these petitions be disposed of, in terms of the statement made by learned counsel for the respondents.

Ordered accordingly.

Pending application, if any, shall also stand disposed of.
