1. This revision petition under Article 227 of the Constitution of India has been filed by the petitioners assailing order dated 29.07.2023 (Annexure P-1) passed in an appeal preferred under Section 29 of the Protection of Women from Domestic Violence Act, 2005, upholding the ex parte order dated 08.12.2022 (Annexure P-2) passed in complaint case bearing number COMA-108-2020, under Section 12 of the Act (supra)
2. A Division Bench of this Court in a recent judgment given in CR-3407-2024, titled as Hemant Bhagat and others vs. Prekshi Sood Bhagat, decided on 25.10.2024 along with bunch of cases, has held that Section 482 Cr.P.C./528 B.N.N.S. is applicable qua proceedings arising out of a complaint under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

3. Faced with the above situation, learned counsel for the petitioners seeks withdrawal of the present petition with liberty to invoke appropriate remedy on the same cause of action, in accordance with law, for redressal of grievances raised in the present petition.
4. Dismissed as withdrawn with liberty aforesaid.
