1. By way of the instant petition, the petitioner assails complaint No.COMP/12816 dated 16.12.2017 as well as summoning order dated 16.12.2017 passed by learned Judicial Magistrate 1 st Class, Chandigarh and all consequential proceedings including judgment dated 12.12.2019 passed by learned Judicial Magistrate 1 st Class, Chandigarh vide which the petitioner stands convicted.

2. This Court finds that as a matter of fact impugned judgment dated 12.12.2019 passed by learned Judicial Magistrate 1st Class, Chandigarh, MOHAN SINGH 2024.10.29 18:16 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh CRM-M-39661-2024 (O&M) (2) convicting the petitioner has already been challenged by the petitioner by way of filing an appeal before the Court of Sessions, which is still pending and is presently stated to be fixed for 26.11.2024. Under these circumstances, without prejudice to the rights of the petitioner in any manner so as to raise all the pleas as have been raised herein, the instant petition is disposed off with liberty to the petitioner to raise all such pleas before learned lower Appellate Court.
