1. The present Civil Revision Petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 19.08.2023 (Annexure P-1) passed by the Civil Judge (Jr. Divn.), Kurukshetra in civil suit No. 425 of 2023 whereby an application under Order VII Rule 11 read with Section 151 CPC filed by the petitioner/defendant has been dismissed.

2. It has been brought to the notice of this Court that vide judgment dated 30.05.2024 passed by the Civil Judge (Jr. Divn.), Kurukshetra has allowed the application under Section 8 of the Arbitration and Conciliation Act, 1996 and the plaint has been ordered to be returned to the plaintiff as per the rules with liberty to present it before the appropriate forum and thus, the present petition has been rendered infructuous.

3. In view of the above, present Civil Revision Petition is disposed of as having been rendered infructuous.

4. Liberty is granted to the petitioner to revive the petition, in case any cause of action survives.
