1. Present revision petition has been filed under Article 227 of the Constitution of India for setting aside the impugned judgment dated 15.01.2024 passed by the first appellate Court vide which it accepted the appeal preferred by the respondent against the order dated 21.02.2017 (Annexure P-3) passed by Civil Judge (Sr. Divn.), Ludhiana vide which the application under Order 9 Rule 13 for setting aside the ex parte judgment and decree dated 03.04.2022 filed by the respondent was dismissed.
2. Learned counsel for the petitioner has submitted that since the suit was filed in the year 1998 by the petitioner for recovery of Rs. 96,10,661/- and the same was decreed ex parte and now the same has been restored vide the impugned order dated 15.01.2024. A limited prayer is being made by learned counsel for the petitioner to the extent that the trial Court be directed to decide the suit as expeditiously as possible.
