By way of the present Criminal Writ Petition, the petitioner seeks issuance of a writ in the nature of mandamus directing the respondent to release her on parole for a period of four weeks to perform last rites on account of death of her mother-Damyanti Devi.
2. The petitioner is a convict and is undergoing life imprisonment for commission of offence under Sections 302 read with Section 120-B and 201 of IPC vide judgment/order dated 17/22.07.2024 passed by learned Sessions Judge, Jhajjar. Presently, the petitioner is confined in District Jail, Jhajjar. The appeal against the aforesaid judgment/order is pending before this Court.

3. Learned counsel appearing for the petitioner submits that the mother of the petitioner expired on 18.10.2024 and presence of the petitioner is required to perform the last rites/ceremonies of her late mother, which are scheduled for 30.10.2024, 31.10.2024 and 01.11.2024.
4. On advance service of copy of petition, Mr. Ashok Chaudhary, Addl. A.G., Haryana, appears and does not dispute the factum of the death of mother of the petitioner.
5. Keeping in view the fact that the presence of the petitioner is required to perform the last rites of her mother, which are stated to be scheduled for 30.10.2024, 31.10.2024 and 01.11.2024, we order that the petitioner will be taken in police custody from 8.00 A.M. to 8.00 P.M. daily on the aforesaid dates, to perform the last rites/ceremonies of her mother.
6. The petition stands disposed of.
7. All the pending application(s), if any, shall also stand disposed of.
