This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to grant the deemed date of promotion to the petitioner on the post of Headmaster High School or on the other higher post for which the petitioner is eligible as per the seniority list in PwD quota will all consequential benefits.

2. Learned counsel for the petitioner contends that the petitioner will be satisfied in case he is permitted to file a representation raising the grievance as has been raised in the instant petition, and the petition may be disposed of by directing the respondents to decide the same in a specified period.

3. Learned State counsel, appearing on advance notice, submits that in case any such representation is filed by the petitioner, the same shall be considered and decided expeditiously.

4. In view of the statement made by learned State counsel, the PAYAL 2024.10.25 18:35 petition is disposed of with liberty to the petitioner to file a representation I attest to the accuracy and authenticity of this order/judgment CWP-28948-2024 2 before respondent no.3 within a period of two weeks from today. In case any such representation is filed, the same shall be decided by respondent no.3/Director, Secondary Education, by passing a speaking order in accordance with law, within a period of three months from the date of receiving the representation.

5. In case the order is not passed within the stipulated period, the officer concerned shall pay costs of ₹50,000 to the petitioner.
