14111-CWP-2023 and CM-14080-CWP-2023 Instant applications have been filed by applicants-Manjeet Singh Saini and three others for impleading them as interveners in the present writ petition as well as for placing on record Annexures A-1 to A-9.
There is no representation on behalf of the applicants despite case called repeatedly.
The applications are accordingly dismissed for non- prosecution.
1 of 2 ::: Downloaded on - 29-10-2024 23:13:59 ::: Neutral Citation No:=2024:PHHC:140797 CWP-15936-2022 (O&M) -2- Main case The present writ petition has been filed under Articles 226/227 of the Constitution of India, 1950, raising a challenge to the letter dated 13.06.2022 (Annexure P-1) as well as letter dated 13.07.2022 (Annexure P- 1A) whereby the road repaired/constructed by the petitioner has been listed in the serious category. A further prayer has been made for issuance of directions to the respondents to constitute a Third Committee (preferably an independent agency and not controlled by the State Government) to inspect and check the quality of the road in question.
Notice of motion in the present petition was issued vide order date 25.07.2022 and thereafter, reply on behalf of respondents No.1 and 2 has also been filed.
This Court while addressing identical facts in CWP-15327- 2022 titled as "Jubilee Enterprises Vs. State of Punjab and others"
decided on 25.07.2024 with other connected matters has already passed a comprehensive judgment.
Learned counsel for the parties are ad idem that the present writ petition can be disposed of in terms of the aforesaid judgment.
Accordingly with the consent of the parties, the present writ petition is disposed of in terms of "Jubilee Enterprises Vs. State of Punjab and others" (supra).
