1. Challenge in the present regular second appeal is to the judgment of the lower appellate Court dated 21.09.1990 vide which the judgment of the trial Court has been set aside and the suit filed by the plaintiffs for joint possession in favour of plaintiff no.1 and 2 and defendant 1 of 2 ::: Downloaded on - 29-10-2024 22:09:44 ::: Neutral Citation No:=2024:PHHC:139589 RSA-1969-1990(O&M), XOBJS-20-C-2014 (O&M) & 2 RA-RS-19-C-2012 no.9-Sher Singh, defendant no.10-Chhotu to the extent of 2/3rd share in the land in suit has been decreed.
2. Learned senior counsel for the appellants as well as learned counsel appearing for the respondents-cross objector have jointly submitted that the entire dispute has been compromised and a detailed compromise deed dated 14.08.2014 has been entered into between the parties. It is submitted that the said compromise has been annexed as Annexure A-1 along with CM-9533-C-2024. It is jointly prayed that the present appeal/cross objections be disposed of in terms of the said compromise. It is submitted that the all the parties would be bound by the terms of the said compromise.
3. The cross objections have been filed by respondent no.3- defendant no.5 Ram Narain.
4. Keeping in view the above said facts and circumstances, the present appeal/cross objections are disposed of in terms of the compromise dated 14.08.2014. The said compromise would form part of the decree. As stated before this Court, all the parties before this Court would be bound by the terms of the compromise.
5. Pending miscellaneous application/ review application stand disposed of in view of the above said order.
