1. On 29.11.2023 counsel appearing on behalf of the appellants had stated that he was no longer in touch with the appellants and prayed for issuance of fresh notices to them and thereafter notices were issued to the appellants and respondent Nos.1 to 21 and 24 to 26.

2. As per the service report, appellant Nos.1 to 7 and 9 remain unserved as they were not found residing at the given address. Notice issued to appellant No.8 has also been received back with the report that no such person was found residing at the given address. Respondent Nos.5, 6, 8, 15, 22 and 24 are reported to have died. Respondent Nos.3(i), 14, 18 to 21 remain unserved as they were not found residing at the given address.

Respondent Nos.7, 9 to 13, 16, 17 and 26 stand duly served. However, none has put in appearance on their behalf.

3. Today again learned counsel for the appellants pleads no instructions in the matter. There is no other address of the appellants available with the Court except the one mentioned in the memo of parties and in the judgments and decrees passed by both the Courts.

4. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

5. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
