1. Learned counsel for the petitioner submits that a similar claim as raised by the petitioner in the present petition has already been extended by this Court to a similarly situated employee while deciding CWP No. 1186 of 2020 titled as Dharam Singh Vs. The State of Punjab and another, decided on 25.04.2024, which benefit is not being given to the petitioner and that too without any valid justification.

2. Notice of motion.

3. On the asking of the Court, Ms. Shruti, Assistant Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondent-State.

Learned counsel for the respondents submits that without even filing a representation, the petitioner has filed the present petition seeking a writ of mandamus, which remedy is not available to him and in case, any 1 of 2 ::: Downloaded on - 26-10-2024 00:50:06 ::: Neutral Citation No:=2024:PHHC:137243 CWP No. 28395 of 2024 2 representation is received from the petitioner raising any grievance based upon the judgment in Dharam Singh's case (supra), the same will be considered and an appropriate order will be passed within a period of eight weeks of the receipt of any such claim and in case, it is found feasible to accept the claim of the petitioner, the same will be accepted, otherwise due reasons will be mentioned in the speaking order, which will be conveyed to the petitioner.

5. Learned counsel for the petitioner submits that in view of the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty to file a representation before the authorities concerned.
