1. Learned counsel for the petitioner submits that the claim raised by the petitioner in the present petition is covered by the judgment of this Court while passing order in CWP No. 10238 of 2017 titled as Jeewan Lata Vs. State of Punjab and others, decided on 10.05.2019, wherein, the service rendered prior to the regularization has been ordered to be taken into account and the judgment of the Division Bench of this Court in CWP No.2371 of 2010 titled as Harbans Lal Vs. State of Punjab and others, decided on 31.08.2010 has also been considered to hold that the employee concerned will be entitled for the pensionary benefits under the Old Pension Scheme.

2. Learned counsel for the respondents has not been able to rebut the fact that in the present case, the petitioner was appointed in the year 1995 and his services were regularized in the year 2003 and he retired from service on 30.11.2021.

3. That being so, the claim of the petitioner is covered by the judgment of this Court in Jeewan Lata's case (supra) and the present petition is also disposed of in the same terms.

4. Pending miscellaneous application, if any, also stands disposed of.
