1. The present second petition is for grant of anticipatory bail to the petitioner in case FIR No.281, dated 22.06.2023, under Section 21 (b) of the NDPS Act (Sections 21-B, 64 and 85 of NDPS Act mentioned in the impugned order), registered at Police Station Sadar Tauru, District Nuh, Haryana (Annexure P-1).
2. Learned State counsel submits that he has instructions to assist that the present petitioner was named by none other than his own brother and his custody is of extreme importance.
3. Learned counsel for the petitioner submits that the petitioner has clean antecedents and has been entangled into this litigation relying upon the disclosure statement of his brother namely Sandeep Singh and one | attest to the accuracy and integrity of this Order/Judgment SANDEEP SETHI 2024.11.21 05:19 PNP REDS SE SEQE XN. VARS ERPS ys SUSE PHN. TSeGh ) Be CRM-M-55401-2024 Abrar, who themselves are main accused and the petitioner has no role to play. Learned counsel for the petitioner also submits that the co-accused have already been granted the concession of regular bail vide order dated 24.07.2023 and 20.07.2023 respectively.

After vehemently arguing on the merits of the case, learned counsel for the petitioner does not press for grant of anticipatory bail to the petitioner and submits that the petitioner is ready to surrender before the trial Court however, prays that in case he applies for grant of concession of regular bail, the same be decided within 03 days.
5. Heard the learned counsel for the parties.

Without commenting on the merits, the present petition is dismissed as withdrawn keeping all the arguments open to the petitioner to be raised before the trial Court with a direction to the petitioner to surrender before the trial Court within 07 days from today and in case, he applies for grant of regular bail, the trial Court shall decide the same expeditiously and preferably within 07 working days.
7. With the above observations, the present petition is dismissed as withdrawn.
