1 The petitioner has filed the instant writ petition under Articles 226 of the Constitution of India, seeking a writ in the nature of certiorari, quashing the impugned letter dated 22.11.2022 (Annexure P-7), rejecting the claim of the petitioner regarding restoration of benefit of 9 years time bound higher pay scale wrongly withdrawn vide order dated 18.01.2016 (Annexure P-5).
2. Learned counsel for the petitioner submits that the present petition is squarely covered by the judgment dated 12.08.2010 passed by the Coordinate Bench of this Court in CWP No.2587 of 2009 titled as 'Rattan Chand Vs. Punjab State Electricity Board and others'(Annexure P-8) which has been followed in CWP No.371 of 2007 titled as 'Pritam Singh Vs. Punjab State Electricity Board and others' decided on 12.10.2010 (Annexure P-9) and Rajinder Parshad Raturi Vs. Punjab State Power Corporation Limited and another : 2013(1) S.C.T. 320 (Annexure P-10) and thereafter, in CWP No.15549 of 2012 titled as 'Sanjay Jindal Vs. Punjab State Power 1 of 2 ::: Downloaded on - 21-11-2024 22:31:16 ::: Neutral Citation No:=2024:PHHC:151819 CWP-17240-2023 -2- Corporation Limited and another' decided on 18.08.2023 against which LPA No.1803 of 2024 tilted as 'Punjab State Power Corporation Limited and another Vs. Sanjay Jindal' filed by the Corporation has been dismissed by the Division Bench of this Court vide judgment dated 17.09.2024.
3. Learned counsel for the respondents despite his best efforts could not dispute the abovesaid legal position.
4. Consequently, the present petition is allowed in the same terms as in CWP No.2587 of 2009 titled as 'Rattan Chand Vs. Punjab State Electricity Board and others', decided on 12.08.2010.
