Complaint NACT/4243/2023 tled "M/s Ac on Construc ons Equipment Limited No. v/s M/s Shree Hospitals Equipments and another"

Seeking quashing of complaint and order of summoning dated

02.12.2023, the accused has come up before this Court under Sec on 528 BNSS, 2023.

2. While hearing the ma er, on a query posed by this Court from counsel for the pe oner, it has been brought to the no ce of this Court that no ce of acquisi on has already been issued, however the said order has not been challenged.

3. Since the no ce of acquisi on is final order and a revisional jurisdic on would apply and the said order is required to be challenged.

4. Faced with the situa on, counsel for the pe oner wishes to withdraw the present pe on with liberty to take appropriate steps to challenge the no ce of acquisi on order and other preceding orders. Counsel for the pe oner further submits that in case pe oner is granted exemp on from personal appearance, they will not claim prejudice in this regard in any Court.

5. Given such assurance, the present pe on is disposed of as withdrawn with the liberty aforesaid. Trial Court to consider the applica on for exemp on from personal appearance of pe oner, if any filed sympathe cally in accordance with law. All pending applica ons, if any, stand disposed.
