CM-17471-CWP-2024 Present application has been filed for disposing of the present petition by preponing the same in view of the order passed in LPA No. 727 of 2023 titled as Kiran Bala and others Vs. State of Punjab and others, decided on 26.09.2024.
Notice of the application to the counsel opposite. Mr. Charan Preet Singh, AAG, Punjab accepts notice on behalf of the respondent-State and raises no objection for the grant of prayer as made in the present application.
Keeping in view the above, the application is allowed and on the joint request of learned counsel for the parties, the main petition is taken up 1 of 2 ::: Downloaded on - 21-11-2024 21:42:33 ::: Neutral Citation No:=2024:PHHC:149481 CM-17471-CWP-2024 in/& -2- CWP-25733-2023 CWP-25733-2023 Learned counsel for the petitioners submits that keeping in view the order passed by the Division Bench in LPA No. 727 of 2023 titled as Kiran Bala and others Vs. State of Punjab and others, decided on 26.09.2024, the petitioners are also entitled for the same relief, hence, the respondents be directed to consider the claim of the petitioners in light of the judgment in Kiran Bala and others (supra).
Learned counsel for the respondents-State submits that the claim of the petitioners will be considered in light of the judgment in Kiran Bala and others (supra) and appropriate order will be passed within a period of eight weeks of the receipt of copy of this order and in case, it is found that the petitioners are similarly situated as the appellants in Kiran Bala and others (supra), appropriate relief will be granted to the petitioners otherwise, due reasons will be mentioned in the speaking order, which will be conveyed to the petitioners.
Learned counsel for the petitioners submits that in view of the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further.
