In the present petition, grievance being raised by the petitioner is that though she has already retired from service but her pensionary benefits have not been released by the respondents and hence, an appropriate direction be issued to the respondents to release the pensionary benefits of the petitioner.

Learned counsel for the respondent-State on instructions from Ms. Parneet Kaur, Assistance Director (Pension) submits that the pensionary benefits have already been released to the petitioner.

Learned counsel for the petitioner concedes the factum qua the release of the pensionary benefits to the petitioner during the pendency of the petition.

At this stage, learned counsel for the petitioner submits that the petitioner is also entitled for the grant of benefit of interest on the delayed 1 of 2 ::: Downloaded on - 20-11-2024 23:23:55 ::: Neutral Citation No:=2024:PHHC:149530 CM-1686-CWP-2024 in/& -2- CWP-18744-2023 release of her pensionary benefits as well as one of the benefit of increment on completion of 12 months of service on the date when she retired from service, as the same has not been extended to her for which benefit, the petitioner is entitled for as per the judgment of the Hon'ble Supreme Court of India in Civil Appeal No.2471 of 2023, titled as, The Director (Admn. & HR) KPTCL and others vs. C.P. Mundanamani and others hence, an opportunity be given to the petitioner to raise the said grievance before the respondents by way of filing appropriate representation.

Learned counsel for the respondents submits that in case, any representation is filed by the petitioner, the same will be decided in accordance with law and appropriate order will be passed within a period of eight weeks of the receipt of copy of this order and in case, it is found that the petitioner is entitled for any relief, the same relief will be granted to the petitioner otherwise, due reasons will be mentioned in the speaking order, which will be conveyed to the petitioner for her information and necessary action.

Learned counsel for the petitioner submits that in view of the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty as prayed for.

Ordered accordingly.
