Apprehending for life and liberty at the hands of the private respondents, the pe oner, invoking the fundamental right of life guaranteed under Ar cle 226 of the Cons tu on of India, has come up before this Court seeking protec on through the State.
2. State counsel on instruc ons from ASI Darshan Singh submits that the wife of the pe oner has made a statement that she does not want to reside with the pe oner and placed on record cer fied copy of statement, which is taken on record.
3. Given such statement, the present pe on is disposed of as the detenue is an adult and she is at liberty to live in accordance with her choice. Regarding the minor son, the son is in legal custody of his mother. In case pe oner wants to seek custody of the child, he has legal rights to proceed in accordance with law. All pending applica ons, if any, stand disposed.
