Learned counsel for the petitioner submits that the petitioner is working with the respondents respondents since the year 1999 and has 25 years to his credit and though there were number of policies which were issued for regularisation of the services of the ad hoc, temporary and daily wage basis employees but the benefit is not given to the petitioner, whi which ch is arbitrary and illegal.

The reliance has been placed upon the judgment of the Hon'ble Supreme Court of India in Civil Appeal No.6798 of 2018 titled "Prem Prem Singh Vs. State of U.P. and ors."

ors. decided on 02.09.2019 according to which an employee who has worked for a sufficiently long time, and then also retired, then also efforts should be made to regularize his/her service so that the concerned employee is able to get the pensionary benefits.

Learned counsel for the petitioner submits that the petitioner petitio has already raised the said grievance in the legal notice dated 16.09.2024 .2024 1 of 2 ::: Downloaded on - 17-11-2024 10:57:43 ::: Neutral Citation No:=2024:PHHC:148928 CWP-30086-2024 -2- (Annexure P-3) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.

Notice of motion.

On the asking of the Court, Mr. Amarpreet Singh Bains, Assistant Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, the legal notice dated 16.09.2024 (Annexure P-3) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of eight weeks from the date of the receipt of certified copy of this order by passing an appropriate speaking order. Learned counsel further submits that in case, it is found feasible to accept the claim of the petitioner, the same will be accepted, otherwise due reasons will be mentioned for not accepting the claim of the petitioner in the speaking order to be passed and the said order will be duly conveyed to the petitioner.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further.

Ordered accordingly.
