The instant appeal has been preferred against the judgment dated 30.11.2005 passed by learned Additional District Judge, Rohtak vide which, the judgment passed by learned Civil Judge, Junior Division, Rohtak has been reversed and the appeal filed by the appellant appellant-respondent respondent has been partly decreed.
2. Learned counsel for the appellant wishes to withdraw the present appeal as the same has become infructuous.
