The present appeal has been filed by the appellants/plaintiffs against the judgment and decree dated 04.12.2015 passed by the Civil Judge (Junior (Junio Division) Pataudi, whereby, the suit for permanent injunction filed by the appellants/plaintiffs has been dismissed and the appeal filed against the aforesaid aforesaid judgment and decree has also been dismissed vide judgment and decree dated 17.07.2019 passed by the District Judge, Gurugram.
2. Learned counsel for the appellants has very fairly submitted that during the pendency of the present appeal appeal, the plaintiffs/appellantss have purchased the said land and the mutations have also been sanctioned.
3. In light of the above, the prayer made in the present appeal 1 of 2 ::: Downloaded on - 14-11-2024 01:06:40 ::: Neutral Citation No:=2024:PHHC:146383 RSA-5928-2019 2019 (O&M) 2 would not survive and therefore, keeping their legal rights open, the appellants wish to withdraw the present petition at this stage.
4. In light of the change circumstances, the present appeal stands dismissed as withdrawn at this stage, without expressing any opinion on the merits of the case.
5. Pending miscellaneous application sha shall stand disposed of.
