CM-18062-C WP-2024:

The present application is filed for preponing the date of hearing in the main case, being CWP-5723-2023, which is otherwise fixed for 10.12.2024; on the ground that the contesting parties have effected compromise.
Learned counsel for the applicants/petitioners submits that the matter has been amicably settled between the contesting parties in terms of Compromise Deed (Annexure A-1).

Ms. Upasana Dhawan, Assistant Advocate General, Haryana and Mr. Sanjay Mittal, Advocate, accept notice on behalf of CM-18062-C WP-2024 in/and CWP-5723-2023 -2- the non-applicants/respondents-State and non-applicants/respondents No.7 to 21, respectively.
Learned counsel for non-applicants/respondents No.7 to 21 submits that except respondent No.10 (Ranbir son of Bholu Ram), who is serving in Army, all the other co-sharers have signed the Compromise Deed (Annexure A-1). However, learned counsel further submits that he has instructions to submit that respondent No.10 is also agreeable with the Compromised Deed (Annexure A-1).
Keeping in view the aforesaid submissions made by learned counsel for the non-applicants/respondents as well as the Compromise Deed (Annexure A-1), the present application is allowed. The main case (CWP No.5723 of 2023) is preponed from 10.12.2024 to today itself and is taken up on Board for further consideration.
CWP-5723-2023:
In view of the submissions made by learned counsel for the parties in the aforementioned application (CM-18062-CWP-2024), the matter has been amicably compromised between the contesting parties by way of Compromise Deed (Annexure A-1).
Accordingly, the present writ petition is disposed of in terms of Compromise Deed (Annexure A-1). Parties would be at liberty to approach the concerned Assistant Collector for effecting final partition in consonance with the said Compromise Deed (Annexure A-1).
All pending application(s), if any, shall also stand closed.
