1. The present revision petition has been filed under Article 227 of the Constitution of India seeking directions to the learned Additional District Judge concerned to pass an appropriate order on the stay application filed along with the appeal being CA/26/2022.

2. Learned counsel for the petitioners would contend that the Trial Court had decreed the suit vide judgment and decree dated 25.01.2022 and since 04.03.2022 the appeal is pending before the First Appellate Court, but the stay application has not been decided.

3. Heard.

4. In the present case the Additional District Judge concerned admitted the appeal on 07.03.2022 and thereafter the matter has repeatedly been adjourned for impleading the legal representative(s) of the deceased respondent. From 22.04.2022 right upto 09.01.2024 repeatedly the counsel for the petitioners had requested for an adjournment on the ground that he AMAN JAIN 2024.11.05 09:23 I attest to the accuracy and integrity of this document 125 CR-6349-2024 (O&M) -2- needed some more time to implead the legal representative(s) of the deceased respondent. On 21.03.2024 none had appeared on behalf of the parties despite the matter been called time and again and the same was adjourned to 29.07.2024. On 29.07.2024 yet again none had appeared for the parties despite the matter been called time and again and the same has now been adjourned to 13.11.2024.

5. In view of what has been noticed above, no exceptional circumstance is made out to issue any direction to the Court concerned for decision of the stay application. Accordingly, the present revision petition, being devoid of any merits, is dismissed. Pending applications, if any, also stand disposed off.
