1. The present petition is for quashing of FIR No.0079 dated 15.04.2021, under Sections 323, 341 and 506 of IPC, registered at Police Station Model Town, Ludhiana, Punjab (Anexure P-1) and consequential proceedings thereof, on the basis of compromise.
2. Learned counsel for the petitioners prays for withdrawal of the present petition.
3. It is a classic case that the petitioners after appearing for the first time on 25.08.2023 have since on the last 04 occasions not appeared before this Court. More so, the complainant never appeared before the trial Court to get his statements recorded which demonstrates that the | attest to the accuracy and integrity of this Order/Judgment SANDEEP SETHI 2024.05.15 00:05 CRM-M-42185-2023 (O&M) compromise was either a travesty or the parties did not enter into a compromise in the first place.
4. In fact the order dated 25.08.2023 specifically stated that there is no observation as to whether the compromise was oral or reduced into writing.
5. In light of the above and without commenting upon the merits, the present petition is dismissed as withdrawn with a direction to the Investigating Agency to cross check and verify as to whether the affidavit (Annexure P-2) is genuine or not.
