1. The instant petition has been filed under Articles 226/227 of the Constitution of India for quashing the impugned order dated 09.04.2024 (Annexure P-23) passed by respondent No.4 and also for canceling the election held on 12.01.2022 for the post of Sarpanch of Gram Panchayat Koer. A further prayer has been made by the petitioners for directing respondent No.4 to withdraw the charge for the post of Sarpanch from respondent No.7.

2. After arguing for some time, learned counsel for the petitioners seeks permission to withdraw the instant petition with liberty to the petitioners to file an election petition before the Court with competent HIMANI GUPTA jurisdiction.

3. In view of the above, the instant petition stands dismissed as withdrawn with the liberty aforesaid and if any such election petition is filed on behalf of the petitioners, the trial Court shall pass an appropriate order, in accordance with law, at the earliest.

4. All pending application(s), if any, shall also stand dismissed.
