1. This is a contempt petition filed under Section 12 of the Contempt of Courts Act, for punishing the respondents for disobeying the order dated 28.01.2016 (Annexure P-3) and the judgment and decree dated 20.05.2011 (Annexure P-1).

2. Counsel for the respondents has submitted that neither the respondents have demolished any part of the building nor have they carried out any major renovation work in the building which is the suit property. Only a portion of roof, which otherwise was about to give in;, has been reinforced by providing the support of an iron Gaurder.

3. In view of the above, this Court does not find any ground to proceed further in the present petition.

4. Dismissed.

5. However, dismissal of the present contempt petition, per se, shall not be taken as effecting rights of either of the parties to the regular second appeal, which shall be considered independent of the order passed in the contempt petition.
