Present writ petition has been filed for directing the respondent-department to decide the representation of the petitioner dated 04.09.2023 (Annexure P-9) expeditiously within some time frame, which is pending before the respondent department as respondent department is not conducting any hearing/proceedings on the petitioner representation, due to the reasons best known to them, in view of respondent No.5 Municipal Council, Bhiwani, RTI information dated 24.01.2023 (Annexure P-4) & 26.05.2023 (Annexure P-8) in view of Hon'ble Supreme Court judgments dated 06.09.2021 (Annexure P-10) passed in Civil Appeal No.4580 of 2021 (Arising out of SLP (Civil) No.33675 of 1 of 2 ::: Downloaded on - 09-05-2024 02:29:59 ::: Neutral Citation No:=2024:PHHC:062779 CWP No.10009 of 2024 -2- 2024:PHHC:062779 2017) titled as "State of Madhya Pradesh and others vs. Pujari Uttan Avam Kalyan Samiti and Another".
2. The writ petition contains the disputed question of facts which cannot be decided by this Court while exercising its jurisdiction under Section 226/227 of the Constitution of India and as such, the present petition is disposed of with liberty to the petitioner to avail his remedies as available to him in accordance with law.
