1. The appellant has filed the instant appeal against judgment and decree dated 16.02.1994 passed by learned Sub Judge IInd Class, Jalandhar, whereby a suit for declaration filed by the appellant/plaintiff has been dismissed and judgment and decree dated 25.07.1997 passed by learned Additional District Judge, Jalandhar, whereby an appeal filed by the appellant/plaintiff against judgment and decree dated 16.02.1994, has been dismissed.

2. On the last date of hearing i.e. 31.01.2024, the following order was passed :-

"Learned counsel appearing on behalf of the appellant submits that the appellant has unfortunately died. He seeks time to get instructions from the family members of the appellant."

3. Learned counsel for the appellant submits that despite his 1 of 2 ::: Downloaded on - 08-05-2024 03:39:19 ::: Neutral Citation No:=2024:PHHC:062216 RSA-3311-1997 -2- best efforts, he has not been able to contact the LRs of the appellant to further pursue the instant appeal.

4. In this view of the matter, the instant appeal is dismissed for non-prosecution with liberty to the LRs of the appellant to revive the same in case any cause of action still survives.
