                        Tribhuvan Dahiya, J (Oral)

The petition has been filed, inter alia, seeking a writ of certiorari setting aside the order dated 12.01.2024, Annexure P-9, passed by the Educational Tribunal on a review application, as well as judgment dated 06.04.2019, Annexure P-3, wherein the appeal filed by the fourth respondent directing the petitioner-society to make payment of leave encashment has been allowed.

2. The petitioner had earlier approached this Court challenging the judgment dated 06.04.2019, which was dismissed as withdrawn granting liberty to avail other remedies with respect to the impugned judgment, vide order dated 06.11.2019, Annexure P-4. Instead of availing other remedies, the petitioner filed a review application before the Educational Tribunal, which was dismissed vide impugned order dated 12.01.2024. After AVIN KUMAR 2024.05.07 08:57 I attest to the accuracy and integrity of this judgment/order. 2024:PHHC:061138 CWP No.9931 of 2024 [2] withdrawing the challenge to the impugned judgment, the petitioner is not entitled to file the instant petition on the plea that review application has been subsequently dismissed by the Tribunal. Besides, it is also apparent on record that the due amount of leave encashment has already been released to the fourth respondent pursuant to an execution application filed by her.

3. In view thereof, there is no ground to entertain the petition.

4. Dismissed.
