1. Learned counsel for the appellants states that he has no instructions in the matter. The present appeal pertains to the year 1995. Vide order dated 03.11.2023 notices were issued to the parties.

2. As per the office report, appellant No.1(i) and respondent No.1(ii) stand duly served. Appellant No.1(ii) and respondent No.1(i) are stated to have died. Respondent no.1(iii) stands served. However, no one has appeared on behalf of appellant No.1(i) despite service. Even the legal representatives of deceased appellant No.1(ii) have not come forward to get themselves impleaded as parties.

3. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

4. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
