It had been noticed by this Court in its order dated 06.11.2023 that the counsel who had filed the appeal is no more and the assisting counsel to the filing counsel pleaded no instructions. Accordingly, notice was issued to the appellant. It was reported by the office that the sole appellant is not residing at the given address while respondents No.1, 2, 3 and 5 have already died while no one chose to appear on behalf of respondent No.4 and respondent No.6 as well.
The matter was still adjourned to enable any person to enter appearance on behalf of the contesting parties. However, no one has chosen to enter appearance or to contest the appeal.
It is also noticed that the plaintiff is in second appeal against the concurrent judgment passed by both the Courts in the suit for possession on the land measuring 1 bigha 16 biswas.
It seems that the appellant is no more interested to pursue the present appeal and his whereabouts are also not traceable.
The present appeal is accordingly dismissed for non-prosecution. Pending, misc. application(s), if any shall also stand(s) disposed of accordingly.
