1. The present petition has been filed by the petitioner under Section 12 of the Contempt of Courts Act, 1971 for initiating contempt proceedings against the respondents for disobedience of order dated 23.08.2023 passed by this court in CWP-18453-2023.
2. In compliance of order dated 23.08.2023, the counsel for respondent has placed on record separate replies by way of affidavits of respondents No.1 & 2, which are taken on record. The Registry is directed to scan the same and make it part of the soft copy of the case.
3. The counsel for respondents, after going through the aforesaid affidavits, has submitted that the order, qua which contempt was asserted, has since been complied with by considering and recommending the case of the petitioner for promotion and the same will be done in the next Departmental Promotion Committee. No further integrity of this document/judgment RAJ KUMAR 2024.05.03 17:36 COCP No.613 of 2024 2024:PHHC: 060906 -2- action is required in the matter. Accordingly, the present petition has been rendered as infructuous.
4. Dismissed as having been rendered infructuous.
5. However, if any grievance of the petitioner is left unaddressed, the petitioner will be at liberty to avail any other remedy, but in accordance with law.
