TRIBHUVAN DAHIYA, J. (ORAL)

This petition has been filed inter alia seeking a writ of certiorari quashing the order dated 15.05.2017, Annexure P-7, whereby the petitioner's services were terminated on account of ineligibility without considering the certificates issued by the Punjab Technical University as well as the Punjabi University, Patiala.

2. It is contended that the petitioner herein is similarly placed as the petitioners in CWP No.15878 of 2014, accordingly, the two matters were ordered to be heard together vide interim order dated 19.05.2017. The petition, CWP No.15878 of 2014, was decided with other connected cases vide judgment dated 12.12.2023, wherein the termination of petitioners' service on account of ineligibility was set aside, and they were awarded consequential benefits in terms of their letters of appointment from the date of joining the post. However, the instant petition could not be heard along with the said petition, and remained pending. The petitioner is accordingly entitled to the same relief as already granted by this Court on 12.12.2023.

3. Learned State counsel is not in a position to dispute that the petitioner is similarly placed as the petitioners in CWP No.15878 of 2014.

4. Accordingly, the petition is allowed in terms of the judgment dated 12.12.2023 rendered in CWP No.15878 of 2014. The impugned order of termination, dated 15.05.2017, is set aside, and the petitioner is held entitled to all consequential benefits in terms of his appointment letter from the date of joining the post. The respondents are directed to release the same within four weeks of receiving a certified copy of this order.
