A.G., Punjab. ***** AMAN CHAUDHARY J. (Oral) 1. These cases involve similar issues and therefore, are being disposed of together by this common judgment. 2. Theprayerinthepresentpetitionsisforquashingtheorderdated 28.07.2014,AnnexureP-3andClause3&4ofguidelinesdated03.03.2014as also the criteria for determining cases of exceptional hardship and further directing the respondents to appoint the petitioners on Government job. 3. Learned counsel would submit that the petitioners were entitled for appointment in terms of the policy dated 08.11.2011, Annexure P-1 on account of the acquisition of their land having taken place for establishing 9 of 10 ::: Downloaded on - 07-05-2024 00:54:26 ::: Neutral Citation No:=2024:PHHC:060637 WP-3398-2018 and C 2024:PHHC:060637 other connected cases 10 Peona Power Plant at village Gobindpura. There are different grounds on which their claims have been rejected by the Deputy Commissioner, which form basis of challenge in these cases but the judgments in theirfavourthat deal with the issues of cutoff date, hardship clause etc., are required to be takenintoconsideration,forwhichtheypraythehigherofficer bedirectedto have a relook in the matter in a time bound manner. 4. LearnedStatecounsel,oninstructions,submitsthataHighLevel Committee consisting ofCommissionerDivision,Faridkot,DistrictAttorney, Legal, Mansa, District Revenue Officer, Mansa, Sub-divisional Magistrate, Budhlada will be constituted with a representative of the department concerned as well, to look into these aspects. 5. The aforesaid satisfied the learned counsel for the petitioners. 6. Inviewoftheaforesaid,thepresentwritpetitionsstanddisposed of for the Committee to be formed to examine the claims of the petitioners afresh within a period of six months, by taking into consideration the pleas and judgments, which the petitioners may raise and cite during course of personal hearing be afforded to them, which this Court has no reason to believetheauthoritieswouldnotaddressinajust,fairandreasonablemanner. Upondoingso,iffoundentitled,grantthemthebenefitforthwith.Needlessto say, if the orders are adverse to their interest, thesameshallcontainreasons and the petitioners shall be free to seek legal redress. 7.
