G.S. Sandhawalia, Acting Chief Justice (Oral) CM-2601-LPA-2024 Application for condonation of delay of 40 days in filing the appeal, is allowed, in view of the averments made in the application, duly supported by affidavit. Delay of 40 days in filing the appeal is condoned.

LPA-1071-2024 (O&M)

1. Consideration in the present letters patent appeal is sought of the interim order dated 15.02.2024 passed by the learned Single Judge in CWP-3350-2024 'Wazir Singh Vs. State of Haryana and others', whereby the stay granted against the present appellant, who was arrayed as respondent No.3 in the writ petition.

2. The appellant has also preferred an application for vacation of stay i.e. CM-3823-CWP-2024. The learned Single Judge had also bothered to call for the record and had gone through the same, which would be clear from order dated 18.04.2024. Apparently, the pleadings are complete and the matter is now pending for 06.05.2024.

3. In such circumstances, we are of the considered opinion that since the learned Single Judge is seized of the matter, it would not be appropriate for us to exercise our discretion, as such, to interfere at this stage, as we would have the benefit of a reasoned judgment very soon.

4. Resultantly, the present appeal is disposed. We are sanguine that the learned Single Judge shall take up the matter on the date fixed.
