1. The petitioner herein is a judgment debtor (Private Limited Company). A decree for recovery of Rs.11,44,923/- alongwith interest @ 12% per annum from 25.01.2001, till the date of realization was passed against the petitioner. During the execution proceeding, conditional warrants of arrest of Judgment Debtor Nos. 2 and 4 were issued. During the pendency of the revision petition, the entire principal amount has been paid.

2. Learned counsel representing the petitioner submits that the Judgment Debtor Nos. 2 and 4 are prepared to appear before the Court and file their affidavits disclosing their assets. In the meantime, the petitioners arrest should be stayed.

3. Learned counsel representing the respondent has no objection.

4. Keeping in view the aforesaid facts, the revision petition is disposed of while directing Judgment Debtor No.2 and 4 to appear in person 1 of 2 ::: Downloaded on - 07-05-2024 21:57:41 ::: Neutral Citation No:=2024:PHHC:059804 CR-3786-2022(O&M) 2024:PHHC:059804 2 before the Executing Court on 17.05.2024.

5. It has been brought to the notice of Court that the execution petition was withdrawn with liberty to file application for revival after the decision of this revision petition. Hence, on the oral request of the learned counsel representing the respondent, the execution petition is revived.
