1. Learned counsel for the appellant states that she has no instructions in the matter.

2. Vide order dated 30.10.2023 notices were issued to the appellant and the respondents. As per the office report, appellant No.1(i) stands served. Appellant No.1(ii) is stated to have died and appellant No.1(iii) is stated to have gone abroad. No one has put in appearance on behalf of appellant No.1(i) despite service. No one has come forward to get themselves impleaded as legal representatives of appellant No.1(ii) nor any counsel has put in appearance on their behalf. This is the only address of appellant No.1(iii) which was given in the memo of parties as well as in the Yogesh Sharma 2024.05.02 10:14 I attest to the accuracy and integrity of this order/judgment.

judgments and decrees of both the Courts. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.

3. Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
