1. The present petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing the impugned notice for recovery dated 22.07.2020 (Annexure P-9) vide which the benefit of 3rd ACP has already been given to the petitioner is being withdrawn after a gap of about 13 years from the date of retirement of the petitioner with a further prayer to direct the respondents to revise the pension of the petitioner according to 7th Pay Commission which has been withheld by the respondents.

2. Both the learned counsels for the parties are ad idem that the prayer of the petitioner is covered by the judgment of this Court in Karam Chand Gupta Versus Haryana State Agricultural Marketing Board and another, CWP No.11489 of 2014, decided on 11.02.2016 1 of 2 ::: Downloaded on - 03-05-2024 02:39:37 ::: Neutral Citation No:=2024:PHHC:059638 CWP-11459-2020 (O&M) -2- 2024:PHHC:059638 and upheld in Haryana State Agricultural Marketing Board and another Versus Karam Chand Gupta, LPA No.873 of 2016, decided on 28.11.2017 and the present petition can be disposed of in terms of the aforesaid judgments.

In view of the above, the present petition is disposed of in the same terms as that of the aforesaid judgment in Karam Chand Gupta Versus Haryana State Agricultural Marketing Board and another (supra) and upheld in Haryana State Agricultural Marketing Board and another Versus Karam Chand Gupta (supra).
