1. The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent to grant benefit of one notional annual grade increment on completion of one year service in the month of January of the respective year.

2. The petitioner is ex-employee of respondent-Bhakhra Beas Management Board. He has retired on attaining the age of superannuation. The petitioner is seeking one notional annual grade increment on the ground that he has completed 1 year service in the month of January and increment was granted w.e.f. February.

3. Learned counsel for the petitioner submits that grievance of the petitioner, at this stage would be redressed, if respondent is directed to decide his representation/legal notice dated 17.03.2024 (Annexure P-6) in terms of judgment of Supreme Court in 'Director (Admn and HR) 1 of 2 ::: Downloaded on - 16-05-2024 04:57:07 ::: Neutral Citation No:=2024:PHHC:067208 CWP-11154-2024 2 KPTCL and others Vs. C.P. Mundinamani and others'2023 SCC OnLine SC 401.

4. Notice of motion.

5. Mr. Abhishek Kumar, Advocate, who on advance notice is present in Court, accepts notice on behalf of respondents No.1 and 2 and files his memo of appearance which is taken on record. Registry is directed to tag the same at appropriate place.

6. With the consent of both sides, the matter is taken up for final disposal.

7. Learned counsel for the respondent asserts that he has no objection, if petition is disposed of with a direction to respondent to decide legal notice of the petitioner in a time bound manner and in view of judgment of Supreme Court in C.P. Mundinamani and others (supra).

8. In the wake of statement of both sides, the present petition stands disposed of with a direction to respondent to decide claim of the petitioner within 3 months from today. The Competent Authority is expected to consider judgment of Supreme Court in C.P. Mundinamani and others (supra) while adjudicating claim of the petitioner.
