1. The appellants have filed the instant appeal against judgment and decree dated 10.12.1993 passed by learned Sub Judge IInd Class, Garhshankar, whereby suit for declaration filed by the respondent/plaintiff has been decreed and judgment and decree dated 12.04.1996 passed by learned District Judge, Hoshiarpur, whereby an appeal filed by the appellants/defendants against judgment and decree dated 10.12.1993, has been dismissed.
2. Learned State counsel, on instructions from Mr. Naresh Kumar, Superintendent, submits that the benefit arising out of the judgments passed by the Courts below have already been released to the respondent/plaintiff and he has already retired from service, on attaining the age of superannuation, on 31.07.2010, therefore, nothing survives in the present appeal.
3. Disposed of as having become infructuous.
