1. The instant writ petition became remanded by the Hon'ble Supreme Court vide order dated 26.02.2024, upon, Civil Appeal No. 3450/2024. The operative part of the said order is extracted hereinafter.

"xxxx..... 5.In view of the above, the impugned order passed by the High Court is set aside and the matter is remitted to the High Court for fresh consideration in the light of the judgment in the case of Indore Development Authority (supra)."

6. It is clarified that all contentions are kept open to be raised by the appellants as may be legally permissible..."

2. After arguing for some time, the learned counsel for the petitioner seeks leave to withdraw the instant writ petition.
