1. No one has appeared on behalf of the appellants. On the previous date also no one had appeared on behalf of the appellants. The present appeal pertains to the year 1996. Vide order dated 14.11.2023 fresh notices were issued to the appellants. As per the Office report, appellants No.1, 2 and 4 are stated to have died. Notice issued to appellant No.3 has been received back unserved with the report that the said appellant is not residing at the given address. No one has come forward to get themselves impleaded as legal representatives of deceased appellants No.1, 2 and 4. There is no other address available with the Court for effecting service of appellant No.3 except for the one mentioned in the memo of parties and in the judgments passed by both the Courts below and the same is the one on which the notice was sent.
2. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
