1. Learned counsel for the petitioners argues that the petitioners are entitled for consideration of their claim for regularization of their services under the policy dated 01.10.2003 keeping in view the judgment of the Hon'ble Supreme Court of India in LPA No.948-2015 titled as State of Haryana and others vs. Khajjan Singh and others decided on 21.07.2015 as well as in LPA No.688-2021, titled as State of Haryana and others vs. Balwinder Singh and others decided on 02.12.2022, which judgments have already attained finality upto the Hon'ble Supreme Court of India.
2. Learned counsel for the petitioners submits that the claim of the petitioners has wrongly been rejected by the respondents vide impugned order dated 17.10.2023 (Annexure P/4) without even noticing as to whether the petitioner's claim is covered under the policy dated 01.10.2003 or not.

3. Notice of motion.
4. Mr. Harish Nain, AAG, Haryana, accepts notice on behalf of the respondent-State and submits that keeping in view the instructions received from the department, order dated 17.10.2023 (Annexure P/4) may kindly be treated as withdrawn with liberty to pass a fresh order on the claim of the petitioners in accordance with law within a period of 08 weeks from the date of receipt of copy of this order.
5. Learned counsel for the petitioners submits that keeping in view the statement of the learned counsel for the respondents, present petition has been rendered infructuous and the same may kindly be disposed of as such.
6. Ordered accordingly.
