1. Learned counsel for the petitioner submits that the petitioner has already retired from service on attaining the age of superannuation on 31.12.2023 and despite the fact that there is no impediment in the release of the pensionary benefits, the same have not been released to the petitioner for the last more than four months whereas, as per the judgment of the Full Bench of this Court in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468, the pensionary benefits are liable to be released within a period of two months of the retirement in case there is no impediment failing which, employee will be entitled for interest.

Learned counsel for the petitioner further submits that the grievance raised in the present petition has already been raised by the petitioner in the legal notice dated 27.03.2024 (Annexure P-1) which is still 1 of 2 ::: Downloaded on - 15-05-2024 21:48:02 ::: Neutral Citation No:=2024:PHHC:064776 CWP-10762-2024 2 pending consideration with the respondents and the petitioner will be satisfied at this stage in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.

4. Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in the Court, accepts notice on behalf of the respondents.

Learned counsel for the respondents submits that in case the legal notice dated 27.03.2024 (Annexure P-1) has been received in the office of concerned authorities and is still pending consideration, the same will be decided by the authorities concerned within a period of eight weeks of the receipt of copy of this order.
6. Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further.
