Date of Decision: 09.05.2024
Iqbal Singh .....Appellant(s)
Versus
State of Punjab and others ....Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA, ACTING CHIEF JUSTICE HON'BLE MS. JUSTICE LAPITA BANERJI Present: Mr. Jitender S. Chahal, Advocate, for the appellant.
Mr. Salil Sabhlok, Sr. DAG, Punjab.
G.S.SANDHAWALIA, ACTING CHIEF JUSTICE (Oral)
1. The present letter patent appeal is directed against the judgment dated 21.04.2023 passed by the learned Single Judge whereby large number of matters were decided. The present appeal is barred by 347 days in filing the same.
2. The reasoning given for the sufficient cause apparently does not convince us. It is a classic case where the appellant has chosen not to file an appeal and had sat back. Only on account of the fact that connected appeals were admitted on 24.04.2024, the present appeal has been filed on 02.05.2024. In the application filed for condonation of delay (CM-2805-LPA-2024), it has been mentioned that the appellant had contacted the earlier counsel on 17.03.2023, who had told him that the case was fixed for 21.04.2024 instead of 21.03.2023 and due to which he had not contacted his counsel. It is only when he contacted his counsel in April, 2024, he was told that his case has already been dismissed on 21.04.2023.
3. We are not convinced with the sufficient cause which is being given.

We are well aware that writ Judges never grant one year's date in motion matters and, therefore, the story which has been cooked up that his counsel in March, 2023 had told that case had been adjourned for April, 2024 does not inspire any confidence with us.
4. In such circumstances, we dismiss the application for condonation of delay and resultantly the main appeal also stands dismissed.
