Present writ petition has been filed for directing the respondents to pay the financial assistant/honorarium allowances to the petitioner, who is the elected Sarpanch of various villages of Block Kapurthala of term 2018 to 2023 from the period, as the respondents have not considered the representation dated 02.02.2024 filed by the petitioner before respondents No.3 & 4 as the petitioner is entitled for the said benefit in the light of the policy decision (Annexure P-1 & P-2). Further prayer has been made that direction may kindly be passed in favour of the petitioner in view of the notification (Annexure P-1) issued by the State of Punjab in favour of the elected Sarpanch and Panches, and the claim of the petitioner may kindly be decided in light of CWP No.28253 of 2017 (Annexure P-3) and also in light of CWP No.7086 of 2020 (Annexure P-4) in which similar issue has been decided, so the 1 of 2 ::: Downloaded on - 23-03-2024 17:56:12 ::: Neutral Citation No:=2024:PHHC:041910 CWP No.7090 of 2024 -2- 2024:PHHC:041910 appropriate order may kindly be passed and the honorarium allowances may kindly be released to the petitioner in the light of above said judgments and further representation dated 02.02.2024 (Annexure P-6) may also be decided according to law.
Learned counsel for the petitioner has submitted that for the redressal of his grievance, the petitioner has already filed his representation dated 02.02.2024 (Annexure P-6) before respondents No.3 & 4 but no action has been taken on the same till date.
Notice of motion.
On asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab appears and accepts notice on behalf of the respondents-State. He submits that the representation filed by the petitioner would be decided expeditiously.
In view of the above position, the present petition stands disposed of with a direction to respondent No.3 i.e. District Development and Panchayat Officer, Kapurthala to look into the representation of the petitioner dated 02.02.2024 (Annexure P-6) and decide the same in accordance with law within a period of four weeks from the date of receipt of copy of the order.
